New Chapter Of TNI Law Now Challenged To The Constitutional Court

The Indonesian National Armed Forces Law (UU TNI) has entered a new phase. The law that was just passed by the Indonesian House of Representatives (DPR RI) is now being challenged by a group of people at the Constitutional Court (MK). 

To note, the TNI Law did receive rejection from a number of parties before and after it was passed. Meanwhile, the law was passed by the DPR on Thursday (20/3) in the Plenary Room of the DPR RI building, Senayan, Central Jakarta. This decision was taken in a plenary meeting attended by a number of ministers. 

At that time, the meeting was led by the Speaker of the DPR RI Puan Maharani who was accompanied by other Deputy Speakers of the DPR, such as Sufmi Dasco Ahmad, Saan Mustopa, and Adies Kadir. 

Minister of Defense Sjafrie Sjamsoeddin, TNI Commander General Agus Subiyanto, Deputy Minister of Finance Thomas Djiwandono, and Minister of State Secretary Prasetyo Hadi were present at the plenary meeting. Puan then invited the Chairperson of the TNI Bill Working Committee, Utut Adianto, to deliver a report on the discussion of the TNI Bill. 

Utut conveyed several crucial points related to the position of the TNI, retirement age, and the involvement of active TNI in ministries or institutions. He ensured that there was no dual function of the TNI in the discussion of the revision of this Law. 

After Utut delivered his report, Puan then asked the members of the Council present whether the Bill could be agreed to become a law. The majority answered in the affirmative. 

"We ask all members whether the Draft Law on Amendments to Law Number 34 of 2004 concerning the Indonesian National Army, can be approved to be passed into law?" said Puan Maharani. 

"Agreed," answered the participants of the meeting followed by the banging of the gavel as a sign of ratification.
